Sucks. That guy is liable for ALL damages and he should replace the car and then some. I hope the car owner sues him and puts that guy out of business!

Nothing a lawyer wouldn't fix right? You guys can sue for coffee stains, and this guy has admitted to dodgyness.

Just because the guy has a business doesn't mean there is enough equity in the business to pay for the car and a lawyer . I hope there is in this case because this is nothing more than mini-car theft. Unauthorized use of a vehicle. what a POS company they should be put out of business so they can't victimize anyone else.

Wouldn't insurance cover this? His car was crashed. It wasn't his fault. Pay up party at fault.

I would think it would cover it to the actual value of the car. Then the insurance company could go after the tuner shop.


The owner could still go after them for any other out of pocket expenses like deductible or if he owed more than the value of the car. etc.

99% of those lawsuits don't amount to anything in court and they are thrown out. Anyone can pay a small fee and file a lawsuit, so you guys scross the pond (and us here) hear all about them, but they end up going nowhere.

If there was no written agreement, the lawyers will get the whole thing stuck in a legal quagmire and _nothing_ will be resolved.
It'll be "He said, she said" until the only thing left are rich lawyers.

I'm really struggling with this guys. Here in Australia, if you crash into someone elses car, and you are NOT at fault, and you have comprehensive insurance, your insurance company will pay, as long as they have all the details from both parties. From what I read on that forum, the guy at fault isn't denying what happened. So my question is, why isn't this an open and shut case for insurance?

It maybe. The problem is the shop owners insurance only wants to pay the car loan off not the out of pocket expense for the car. The guy that owns the car may have made a big down payment and figures the car is worth more than just the loan payoff.

I think his insurance company will pay him for the MARKET VALUE of the car. That may not make the car owner whole though.

his insurance paid a little more than the NADA of the car.

at this point its a matter of going after the shop for the wrong doings.

at least they didnt make 50 dyno pulls and blow his engine. they had the decency to destroy the whole car.

I laugh at people who say crap like this because what does it accomplish? Nothing except you'll see the inside of a jail cell.

Not the case....technically, the shop owner can deny all accounts. He was not driving..the person driving is completely responsible for his actions, and he is the one to pay for the cars' damages. Then, after that, the OWNER of the car can SUE (civil suit) the owner of the business.
