Dented Oil Pan?

So myself and some others are in disagreement about something. Is this oil pan dented?
i didn't want to post this on 3si because the people i'm in disagreement with are on there, and i didn't want to start a shit fest thread. just some honest opinions. i'm trying to find some other good pictures of oil pans for comparison, but so far haven't really turned up anything on stealth316. thanks guys.
edit: also, if it is dented, how severe is the dent, and will it cause any problems?

yes thats dented. and it could cause problems. the pick up tube sits about a 1/4 inch off the bottom of that pan.

yes its dented. Its barely dented you might get lucky and you should be ok. I wouldnt take the chance though. THe oil pickup is only a few cm's above the bottom of the pan.

ok, i don't want to start crap, but i gotta get a second opinion on this. here's the story. some of you may know my car has been at ips (for near two years now) getting the engine rebuilt and some other upgrades. well i went home over thanksgiving (i'm in florida, the car is in ohio, obviously). i drove the car around to get the 500 break-in miles on it. after some inspection, i found this oil pan dent (among other things). when i took the car back to IPS (for the final tuning on the emanage, etc.) i informed jeff of the dent, and that it wasn't like that when i dropped the car off back in jan. 2006. but i didn't know when it occured, because this is really the first time i've crawled under the car since before then. he told me he'd look at it. that was saturday. i get a call today from mike. he says it's not dented. it looks identical to a new oil pan sitting next to him. after that i go and start looking at the picture i had taken last week (the one i posted above), and made this thread, and looked for an "undented" oil pan picture. then i give them a call back. mike and i go back and forth a bit about wether it's dented or not. in the end, he's going to send me some pictures and i'm going to send him some pictures to show what we're both talking about, since i can't be there in person. he does say that, if i want, he will drop the pan and take measurements between the pickup and the pan etc, but if it's not out of spec than i'd get charged for the labor. he also mentioned that i shouldn't have any problems with it being the way it is. i do have good oil pressure. better than i'd ever seen during the year and a half i had the car before it went to IPS (granted it's on the stock guage, but it's considerably higher).
i just dug around on my desktop (which i drug out of storage, i'm living in a hotel currently) and found an old picture of my oil pan, back from july 2004:
it seems quite clear that it's not dented. they've assured me that the pan on there now is my original that came with the car. so should i really be concerned about this? am i getting screwed here? please don't make this a "bash ips" or "bash name_your_shop" thread. i really just need some other opinions on this. the car is scheduled to to go on the dyno to get tuned any time now. today or tomorrow.

its still a little dented in the 2nd pic but in the front of it. Clean it a little and actually put your hands on it. You will feel a dent, and after looking at the other pics you should know what a dented one looks like.

moff, the second pic is the "before" picture. taken in 2004. the first picture in the first post is the "after" picture, taken last week.
dciv, well i'm back in florida now. but i did feel it, and it was pushed in slightly. it's not severe, but it's noticable.
edit: also, anyone know what the spec is for the distance between the pickup tube and the oil pan? the tolerance?

okay, in the second pic, the pan is most definately NOT dented, but it is in the first.
Are we looking at the same car in both pics?
I see scratch marks on the crossmember that are not visible in the second pic.
There's a rust "spot" above the drain plug in the first pic that isn't present in the second.
The exhaust is more rusted and doesn't have a cat like the second pic.

I would have to say that yes the oil pan is dented in compared to the second pic. Can't tell from the pic how far the dent is though. On the second pic it actually looks like it has been dented back out/down where as the first pic(current) looks dented in/up.

mono, they are the same car. mine. the picture in post #11 was taken in july 2004, when i put the 3sx downpipe on the car. the picture in post #1, was taken last week. that's why there are differences in exhaust rust, cat, etc.
dciv, the second picture (in post #11) is not how the car is now. that was 3 years ago. the car is currently how it is in the first picture, post #1.
so how worried should i be about this dent? i emailed the pictures to IPS yesterday, haven't heard back yet.
