Ask them to find comparable ones, then you find them and show them.

There are no 07 V8 Explorer within 100 miles of me. There are two 06-10 V8 4x4's in that range. One is a well used 06 with 40k more miles and the other 2010 limited for $14,450. They are offering me less than $9k plus tax and licensing.

Now they sent me an email saying they are not responsible for the replacement value, just the market value

On the market I'd have to spend more than they are offering me as the market value...

Just find ones that are close to what yours was, not even necessarily in CA, and show them the market value.

You definitely won't get replacement value, unless you paid for that type of insurance, as they aren't going to give you the money that was lost to depreciation.

I've done that and they rejected them as comps because they were out of my market.

I've even pulled V6s with more miles and similar options with a price more than what they offered and they rejected it.

Call them up, lately I’ve had really good luck with asking to go up the chain of command. My insurance, progressive, tried to tell me they are all equal and so it wouldn’t help. I laughed at him and said, so you have no boss? Pass me up the line. The higher person fixed it. Same with my shipping, it didn’t work out but getting passed up at least found a helpful person.
